Court Dismisses Purported Nationwide Class Action and Compels Arbitration

Cahill is national defense counsel in a series of class action lawsuits filed against Time Warner Cable Inc. (“TWC”) in connection with its October 2012 decision to begin charging a monthly modem lease fee. Two actions, filed by plaintiffs purporting to represent classes of TWC subscribers in South Carolina and other states in which TWC provides services, alleged breach of contract and violation of consumer protection statutes and sought several hundred million dollars in damages. TWC moved to compel arbitration in both actions pursuant to the terms of its contract with each of the plaintiffs, and the United States District Court for the District of South Carolina granted the motions and dismissed both actions without prejudice pending arbitration of the plaintiffs’ claims.
